CYBER PULSE DEV is strictly an independent software development, technical consulting, and API integration technology vendor. Once custom software, scripts, or APIs are delivered to the client, CYBER PULSE DEV bears zero operational liability, zero financial custody, and zero responsibility for how the client uses the system, manages funds, or operates within their jurisdiction. By contracting our services or utilizing our code, you explicitly accept all terms stated herein.
Nature of Services & Neutral Technology Vendor Status
CYBER PULSE DEV provides bespoke web engineering, customized backends, API gateways, database architecture, and integration scripting services.
- CYBER PULSE DEV operates exclusively as an independent technical contractor.
- We do not operate gambling establishments, online casinos, financial payment gateways, or gaming operator services directly to the general public.
- All platforms, source code, and integration scripts delivered to clients are commissioned tools intended solely for the client's autonomous operation.
Post-Delivery Operational Liability & Zero Liability Clause
Upon the completion, handover, server deployment, or API key generation for any project, the client assumes 100% full, unshared, and unrestricted responsibility for the software's management and deployment.
Non-Liability Undertaking:
CYBER PULSE DEV, its developers, engineers, contractors, and owners SHALL NOT BE HELD LIABLE, CRIMINALLY OR CIVILLY RESPONSIBLE for:
- How the software is deployed, modified, configured, or branded by the client.
- Any illegal, unauthorized, unlicensed, or unlawful activity carried out through the client's platform, domains, or downstream reseller networks.
- Any operational downtime, regulatory seizure, IP blocking, or hosting suspension resulting from the client's business practices.
Financial Transactions, Player Funds & Non-Custody Disclaimer
CYBER PULSE DEV does NOT handle, collect, hold in escrow, or intermediate any player money, user deposits, cashouts, or gaming funds.
- All cashier wallets, UPI merchant gateways, cryptocurrency wallets (USDT/BTC), bank accounts, and player balance reconciliations are managed exclusively by the client and their payment service providers.
- CYBER PULSE DEV disclaims any liability for financial losses, unpaid player winnings, cashier chargebacks, fraudulent transactions, or payment gateway freezes.
- The client is exclusively responsible for maintaining their own financial reserves and processing all player deposits and withdrawals honestly and lawfully.
Jurisdictional Compliance & Licensing Requirements
The client warrants and guarantees that:
- They possess all necessary licenses, permits, and governmental authorizations required to operate web services in their respective geographic target markets.
- They will not offer services to individuals residing in prohibited jurisdictions or underage users.
- They will adhere strictly to Anti-Money Laundering (AML) and Know Your Customer (KYC) standards applicable to their sector.
Indemnification Agreement
The client agrees to fully indemnify, defend, protect, and hold harmless CYBER PULSE DEV, its principals, developers, affiliates, and technical partners against any and all claims, damages, liabilities, costs, governmental penalties, legal fees, or lawsuits arising directly or indirectly from:
- The client's operation, deployment, or misuse of the delivered technology.
- Breach of any local or international laws, regulatory orders, or copyright terms by the client.
- Any disputes between the client and their downstream operators, master resellers, resellers, affiliates, or end players.
"As-Is" Software Provision & Intellectual Property
All technical architecture, codebases, and API bridges are provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of uninterrupted uptime, commercial profitability, or specific business outcomes. Custom code delivered specifically under contracted agreement becomes the property of the client upon full settlement of contracted development fees.
Modifications & Termination
CYBER PULSE DEV reserves the right to modify these Terms of Service at any time. Continued usage of our services or infrastructure following modifications constitutes agreement to the revised terms. CYBER PULSE DEV reserves the right to terminate technical support or API gateway access for any client found engaging in active malicious cyberattacks, system tampering, or extortion.
